Press Trip Disclaimer – Elite Hotels (Rotherwick) Ltd
This disclaimer outlines the terms under which Elite Hotels (Rotherwick) Ltd provides complimentary accommodation or services to influencers, content creators, or media representatives (“Guest”) as part of a hosted stay, press trip, or promotional collaboration.
By accepting a complimentary stay or service, the Guest agrees to the following:
- Disclosure and Transparency
The Guest must clearly disclose in all associated content (social media, blogs, video, etc.) that their stay was complimentary or part of a hosted press trip.
This is in accordance with the UK Code of Non-broadcast Advertising (CAP Code), overseen by the Advertising Standards Authority (ASA), and the guidance of the Competition and Markets Authority (CMA). Suitable disclosures include terms like “AD – Press Trip with [Hotel Name]” or “Gifted Stay”.
- No Obligation to Post
Unless explicitly agreed in writing, the Guest is not contractually obliged to create or share content in exchange for the stay.
- Content Ownership and Usage
The Guest retains ownership of all content produced. The [Host Hotel] may request permission to re-share publicly posted content (e.g. Instagram Stories or blog posts) with appropriate credit, or request for specific content to be captured on their behalf for further use. Written consent is required for any commercial use.
- Editorial Independence
The Guest maintains full creative and editorial control. All opinions shared should reflect their genuine experience and comply with the ASA's requirement for truthful advertising.
- No Employment Relationship
This collaboration does not create a relationship of employment, partnership, or agency between the Guest and the [Host Hotel].
- Liability and Assumption of Risk
The Guest agrees to act responsibly and is personally liable for their health, safety, and belongings throughout their stay. The [Host Hotel] shall not be liable for any injury, loss, or damage, unless arising from its proven negligence or that which cannot be excluded under UK law.
- Professional Conduct and Confidentiality
The Guest agrees to behave in a professional and respectful manner at all times. Any confidential or proprietary information provided by the hotel must not be disclosed or published without prior written consent.
Property Damage
The Guest will be held financially responsible for any damage caused to the hotel property (including rooms, furnishings, or communal areas) by themselves or their guests during the stay. The [Host Hotel] reserves the right to charge for repairs, replacement, or cleaning as deemed necessary. Any such charges will be communicated to the Guest before being applied.
By participating in a hosted stay with the [Host Hotel], the Guest confirms they have read, understood, and accepted the terms outlined in this disclaimer.
